Summary
This is a legally binding agreement between you (“you” or “user” or “client”) and TruthMap, Inc. (“TruthMap”, “the Company”, “we”, or “us”). TruthMap, Inc., a Florida corporation, makes its life coaching services and this website, including all information, articles, communications, files, text, graphics, and audio/visual files (“Content”, “Services”, '“Products”, “Digital Products”, “Site”) and it’s iOs and Google mobile app (“the App”, “Mobile Application”, “TruthMap App”, “Sight”) available for your use, subject to these Terms and Conditions. To make it easier, we refer to the TruthMap web property and the app individually and collectively as the “Site.”
PLEASE READ THESE TERMS CAREFULLY BEFORE USING THE SITE. THEY AFFECT YOUR LEGAL RIGHTS AND OBLIGATIONS. BY ACCESSING, USING, OR DOWNLOADING ANY MATERIALS FROM THIS SITE (INCLUDING OUR MOBILE APP), OR HIRING A LIFE COACH THAT IS CERTIFIED IN THE COMPANY’S METHOD, YOU AGREE TO THESE TERMS. THESE TERMS AND ANY ADDITIONAL TERMS AND CONDITIONS CONTAINED IN THE SITE – APPLY TO YOU. We reserve the right to change these Terms and Conditions at any time, without prior notice to you or any Site visitor. Any updates to the Terms and Conditions will apply; you are responsible for checking updates when you return to the Site.
TruthMap is a life coaching company and content company that provides emotion coaching and life coaching. We provide Materials on the Site for general informational purposes only, and these are not intended or implied to serve as therapeutic advice, diagnosis, or treatment. You should not use this information to diagnose or treat any physical or mental health issues. The Site is not providing any therapeutic advice. If you have or suspect you have a health problem, you should consult your doctor or therapist.
Disclaimer: Our App's Distinction, Purpose, And Release of Claims
The following applies to users of the TruthMap mobile application ("the App"). The use of the TruthMap app does not constitute a substitute for professional mental health care or crisis intervention services. The App is intended for self-coaching for emotions and self-exploration purposes only. The App is categorized and identified as an app providing life coaching. It is important to understand that our app is not to be considered or classified as a mental health app. It is not designed or intended to be utilized as a crisis intervention tool. If you are need of immediate mental health support please call the suicide prevention hotline at 988 if you are a U.S. resident. If you are an international resident a list of emergency and mental health hotline phone numbers can be found here. This list is provided as a courtesy and is not exhaustive.TruthMap is not responsible for providing crisis intervention or contact information for your respective state or region. The App is intended to assist users in navigating their emotions and promoting emotional well-being, with the purpose of getting to know one’s internal self-understanding of their behaviors. While we strive to provide helpful guidance and support, it is essential to seek appropriate professional help in case of mental health crises or severe emotional distress. If you are experiencing a mental health emergency or require immediate assistance, please contact emergency services or consult a qualified mental health professional. By accessing and using the App, you acknowledge and understand the distinction we make regarding its classification, purpose, and limitations. We strongly encourage you to prioritize your mental health and seek professional assistance when necessary.
Release Of Claims
A life coaching client on behalf of themselves and their representatives, spouse, agents, heirs, parents, and all relatives both genetically related or married into their family of origin, non-married romantic partners, friends, business partners, and assigns, irrevocably and unconditionally, release and discharge the Company, including its parents, subsidiaries, affiliates, and related companies and/or subsidiary entities, including, without limitation, all the Company's former, current, or future officers, employees, representatives, agents, fiduciaries, attorneys, directors, shareholders, insurers, predecessors, parents, affiliates, benefit plans, successors, heirs, and assigns from any and all claims, liabilities, causes of action, damages, losses, demands or accounts, judgments, rights, charges, complaints, obligations, promises, agreements, controversies, suits, expenses, compensation, responsibility, and liability of every kind and character whatsoever (including attorneys’ fees, expenses, and costs), obligations of every kind and nature, whether now known or unknown, suspected or unsuspected, which the user ever had, now has, or hereafter can, shall, or may have for, upon, or by reason of any act, transaction, practice, conduct, matter, cause, or thing of any kind whatsoever, relating to or based upon, in whole or in part, any act, transaction, practice, or conduct prior to the date of downloading the app. By accepting these Terms and Conditions and using the App, you acknowledge and agree that you are voluntarily releasing the Company and its associated entities from any claims, liabilities, or obligations arising from your use of the app. This release covers any legal rights or causes of action, known or unknown, that may have arisen prior to the date of downloading the app. It is important to carefully consider the implications of this release and seek legal advice if necessary before using the App.
Disclaimer: Distinction between Licensed Mental Health Counselors and Life Coaches; Independent Contractor Status of TruthMap Life Coaches; Liability Exclusion
Distinction between Licensed Mental Health Counselors and Life Coaches: It is essential to understand the clear distinction between licensed mental health counselors and life coaches. Licensed mental health counselors are trained mental health professionals operating in the regulated field of healthcare. They are required to obtain licensure as a mental health counselor in the respective state in which they operate, which involves completing a license-eligible master's or doctoral program in counseling and meeting specific state licensing requirements. On the other hand, life coaches are not regulated by any state licensing body and do not have mental health training. They provide guidance, motivation, and support in helping individuals achieve personal and professional goals. Unlike licensed mental health counselors, life coaches are not equipped to diagnose or treat mental health conditions unless a life coach has prior training and licensure as a therapist, which may occur in some cases. TruthMap Life Coaches as Independent Contractors: TruthMap life coaches are independent contractors who operate their own coaching practices. As independent contractors, they have their own policies, terms, and conditions that govern their coaching services. These policies may vary among individual life coaches, and each life coach is solely responsible for setting their rates, defining their scope of services, and establishing their business practices. Disclaimer of Liability for Life Coaches' Actions: It is essential to recognize that TruthMap, Inc., the Company providing the TruthMap App, and TruthMap Life Coaching, is not liable for the actions, conduct, or services provided by its independent contractor life coaches. Each life coach is solely responsible for their coaching services and interactions with clients. While TruthMap takes measures to carefully select and onboard qualified life coaches, the Company does not have direct control over their operations, qualifications, or expertise. Therefore, any engagements, arrangements, or agreements made between users of the TruthMap App and life coaches are entirely independent of the Company. Acknowledgment of User Responsibility: By working with a TruthMap life coach, you agree to acknowledge and understand that the Company is not responsible or liable for any outcomes resulting from interactions with life coaches or the services provided by them. You are encouraged to exercise your due diligence, research, and evaluate the qualifications and credentials of life coaches before engaging in coaching sessions. Consultation with Licensed Mental Health Professionals: Users are advised to seek the services of licensed mental health professionals if they require assistance with diagnosing or treating mental health conditions. While life coaches may provide valuable guidance and support, they are not qualified to offer mental health diagnoses or treatments. Release of Liability: The life coaching client on behalf of themselves and their representatives, spouse, agents, heirs, parents, and all relatives both genetically related or married into their family of origin, non-married romantic partners, friends, business partners, and assigns, irrevocably and unconditionally, release and discharge the Company, including its parents, subsidiaries, affiliates, and related companies and/or subsidiary entities, including, without limitation, all the Company's former, current, or future officers, employees, representatives, agents, fiduciaries, attorneys, directors, shareholders, insurers, predecessors, parents, affiliates, benefit plans, successors, heirs, and assigns from any and all claims, liabilities, causes of action, damages, losses, demands or accounts, judgments, rights, charges, complaints, obligations, promises, agreements, controversies, suits, expenses, compensation, responsibility, and liability of every kind and character whatsoever (including attorneys’ fees, expenses, and costs), obligations of every kind and nature, whether now known or unknown, suspected or unsuspected, which the user and client ever had, now has, or hereafter can, shall, or may have for, upon, or by reason of any act, transaction, practice, conduct, matter, cause, or thing of any kind whatsoever, relating to or based upon, in whole or in part, any act, transaction, practice, or conduct prior to the date of downloading the app. By accepting these Terms and Conditions and seeking life coaching services with a TruthMap Coach or using the App, you acknowledge and agree that you are voluntarily releasing the Company and its associated entities from any claims, liabilities, or obligations arising from your use of the app or receipt of the life coaching services. This release covers any legal rights or causes of action, known or unknown, that may have arisen prior to the date of downloading the app or obtaining the services.
Please feel free to browse the Site without creating an account. However, certain services may only be used if you have created an account profile. When you create an account, please provide us with the most accurate and complete registration information, as prompted by the registration form. Also, please promptly notify us if any of this information changes. Failing to provide or update accurate information may result in the termination of your right to use the Site. To set up an account, you will need to provide an email address and password to access the Site. The security and confidentiality of your username and password are your responsibility. Please notify us immediately if an unauthorized person has obtained your password or accessed your account by emailing us at contact@truthmap.co. We are not liable for any loss that may incur as a result of someone else using your password or account, either with or without your knowledge or permission. TruthMap follows generally accepted industry standards to protect the personal information submitted to TruthMap, both during transmission and once we receive it. However, no method of transmission over the Internet or method of electronic storage is 100% secure. Therefore, while TruthMap strives to use commercially acceptable means and domain hosts prominent in the industry to protect your personal information, absolute security cannot be guaranteed.
On TruthMap, you will be able to share comments and other information with the TruthMap Community. You are solely responsible for all content posted and all activity that occurs under your account (“User Content”). By posting User Content, you: · Promise that you have the right to post all such User Content · Grant us the right to use and share User Content in any manner and for any purpose in any and all formats and technologies · Agree that User Content is subject to being changed, rejected, or deleted at any time without notice or explanation to you · Understand that all User Content will be treated as non-confidential and will not be returned to you · Agree that we have no obligation to enforce any intellectual property rights in or to your User Content
You must be 18 years or older to use the Site. In using the Site, you agree to (a) keep intact all trademark, copyright, and other proprietary notices; (b) not use the Materials in a manner that suggests an association with any of our products, services, or brands; and (c) make no modifications to the Materials. All Materials on the Site are for your individual, personal, and non-commercial use. You may not sell or modify the Materials or reproduce, transfer, upload, post, display publicly, or otherwise use the Materials in any way other than as permitted by US copyright law or these Terms and Conditions. You must obtain written consent and permission prior to any reprinting or electronically reproducing any document or graphic, in whole or in part, from the Site. TruthMap owns, controls, or has a license to all the Materials available on the Site, and the Materials on the Site are protected from unauthorized use, copying, and dissemination by US and international intellectual property laws. You are not permitted to commercially or promotionally distribute or publish any content, code, data, or Materials from the Site unless you have our prior written permission. NOTE: You may create a plain text hyperlink to the pages of our Site provided that neither you nor the link portrays TruthMap products and services in a false or disparaging manner or suggests sponsorship, affiliation, or endorsement by or with us. We may revoke this permission at any time for any reason upon notice to you. You may not “frame,” link, or similarly display any of our content or property, including, without limitation, the Site. You may not use any of our trademarks as part of the link without our express written permission.
TruthMap respects the intellectual property rights of others and expects our users to do the same. We may remove any User Content that appears to infringe the copyrights of others. In addition, we may terminate the accounts of users who infringe our copyrights or the copyrights of others. Unless otherwise identified, all Content (other than User Content) is property of TruthMap and is protected by U.S. and International copyright laws. Reproduction and distribution of any part of any TruthMap Content without our written permission are prohibited. Per the DMCA, TruthMap will respond expeditiously to claims of copyright infringement on the Site if submitted to TruthMap’s Copyright Agent identified below. Upon receipt of a notice alleging copyright infringement, TruthMap will take whatever action it deems appropriate within its sole discretion, including removal of the allegedly infringing materials and termination of access for repeat infringers of copyright-protected content. If you believe that your intellectual property rights have been violated by TruthMap or by a third party who has uploaded materials to our website, please provide the following information to the designated Copyright Agent listed below: A description of the copyrighted work or other intellectual property that you claim has been infringed; A description of where the material that you claim is infringing is located on the Site; An address, telephone number, and email address where we can contact you and, if different, an email address where the alleged infringing party, if not TruthMap, can contact you; A statement that you have a good-faith belief that the use is not authorized by the copyright owner or other intellectual property rights owner, by its agent, or by law; A statement by you under penalty of perjury that the information in your notice is accurate and that you are the copyright or intellectual property owner or are authorized to act on the owner's behalf; Your electronic or physical signature; Your email to our Copyright Agent must contain the following description in the subject line: NOTICE OF POTENTIAL COPYRIGHT INFRINGEMENT – DMCA. TruthMap may request additional information before removing any allegedly infringing material. In the event TruthMap removes the allegedly infringing materials, TruthMap will immediately notify the person responsible for posting such materials that TruthMap removed or disabled access to the materials. TruthMap may also provide the responsible person with your email address so that the person may respond to your allegations. Digital Product Support
Excluding the mobile application, TruthMap guarantees all online web-based digital products for a period of 1 year. In the unlikely case a digital product is no longer supported before that time, we will refund the pro-rated purchase price from the date it becomes unavailable up until the 1-year mark from its launch date. After the 1-year guarantee period, TruthMap will offer to replace the product with the nearest comparable updated version within that specific category of digital product.
Online Courses
TruthMap has a 30-day 100% Satisfaction Guarantee on all our Online Courses. We are committed to offering our customers the highest level of personal satisfaction. If for any reason you are unsatisfied with your purchase, you may request a refund or exchange within 30 days of purchase. Email info@truthmap.co for any refund or exchange request.
Online Course Payment Plans
Payment plans are available for select courses on Truthmap.us. These plans have different prices than Pay-in-Full options. Installment plan and pricing are dependent upon the individual course and are subject to change without notice. The first payment is due at the time of enrollment. Subsequent payments are automatically charged every 30 days based on the terms of the payment plan you have selected. If a payment is not successfully settled, due to expiration, insufficient funds, or otherwise, you remain responsible for any uncollected amounts and authorize us to continue billing the payment method, as it may be updated.
Live Event Registrations
Live Event Payments Live event registrations and payments are made in full at the time of enrollment. Enrollment is not complete until the payment is processed. Live Event Cancellation & Refund Policy You may cancel a live event registration within 36 hours from the time of payment to cancel and receive a full refund. Cancellations after 36 hours from payment will be converted to a non-refundable Program Voucher for the original amount paid, less any applicable cancellation fees. Program Vouchers may be applied toward any future TruthMap live event. Some restrictions apply.
Content Membership
TruthMap Content Membership will continue month-to-month unless and until you cancel your membership, or we terminate it. You must provide a current, valid, accepted method of payment (as such may be updated from time to time, "Payment Method") to use the service. You will be billed monthly for the fee to your Payment Method. You must cancel your membership before it renews each month to avoid billing for the next month's membership fees. Recurring Billing. By starting your TruthMap Content Membership and providing or designating a Payment Method, you authorize us to charge you a monthly membership fee at the current rate. Price Changes. We reserve the right to adjust pricing for our service or any components thereof at any time as we may determine necessary. Any price changes to your service will take effect following email notice to you. Billing Cycle. The membership fee will be billed at the beginning of the paying portion of your membership and each month thereafter unless and until you cancel your membership. We automatically bill your Payment Method each month on the calendar day corresponding to the commencement of your paying membership. Membership fees are fully earned upon payment. No Refunds. CONTENT SUBSCRIPTION PAYMENTS ARE NONREFUNDABLE, AND THERE ARE NO REFUNDS OR CREDITS FOR PARTIALLY USED PERIODS. Following any cancellation, however, you will continue to have access to the Service through the end of your current billing period. Your membership must be canceled a minimum of 24 hours before your monthly charges occur. Payment Methods. You may edit your Payment Method information on our website. If a payment is not successfully settled, due to expiration, insufficient funds, or otherwise, and you do not edit your Payment Method information or cancel your account (see, "Cancellation" below), you remain responsible for any uncollected amounts and authorize us to continue billing the Payment Method, as it may be updated. Cancellation. You may cancel your Content Membership at any time, and you will continue to have access to the service through the end of your monthly billing period. WE DO NOT PROVIDE REFUNDS OR CREDITS FOR ANY PARTIAL-MONTH MEMBERSHIP PERIODS. To cancel your membership, go to our website and in your account go to the subscription page and click on the CANCEL SUBSCRIPTION button. If you cancel your membership, your account will automatically close at the end of your current billing period. To see when your account will close, click "View billing details" on the "Your Account" page.
Mobile Services And Licensing End User Agreement
The following applies to users of the TruthMap mobile application ("the App"). The use of the App requires a mobile device and wireless mobile data service, which must be obtained from your wireless carrier, and may require internet access, which must be obtained from your service provider. You are responsible for obtaining and paying for such additional services and obtaining a suitable device, including all usage charges related thereto. You may be required to send and receive, at your cost, electronic communications related to the App, including administrative messages, service announcements, diagnostic data reports, and App updates, from TruthMap, your mobile carrier, or third-party service provider. If you do not have an unlimited wireless mobile data plan, you may incur additional charges from your wireless service provider in connection with your use of the App. You are solely responsible for obtaining any additional subscription or connectivity services or equipment necessary to access the App, including payment of all third-party fees associated therewith, including fees for information sent to or through the App. We do not warrant that the App will be compatible with your network provider or device. You acknowledge and agree that we may release updates to the App, and you may be required to install any such update to continue using the App properly. You may not export the TruthMap mobile application except in compliance with all applicable laws.
iOS App
The following applies if you obtain the App from Apple Inc.'s ("Apple") App Store. You acknowledge and agree that these terms of service are solely between you and TruthMap, Inc., not Apple, and that Apple has no responsibility for the App or its contents. Your use of the App must comply with the App Store Terms of Service or other terms applicable to the use of the App. You acknowledge that Apple has no obligation to furnish any maintenance and support services with respect to the App. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will be responsible for any refund of the purchase price for the App, if any, to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation with respect to the App. You acknowledge that Apple is not responsible for addressing any claims relating to the App or your possession and use of the App, including but not limited to product liability claims, claims that the App fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection or similar legislation. All such claims are governed solely by these terms of service and any law applicable to TruthMap, Inc. as the provider of the App. You acknowledge that in the event of a claim that the App and your possession and use thereof infringe a third party's intellectual property rights, TruthMap, Inc., not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim to the extent required by these terms of service. You represent and warrant that (a) you are not located in a country that is subject to a U.S. government embargo, or that has been designated by the U.S. government as a "terrorist supporting" country; and (b) you are not listed on any U.S. government list of prohibited or restricted parties. You and TruthMap, Inc. acknowledge and agree that Apple and its subsidiaries are third-party beneficiaries of these terms of service and that, upon your acceptance of these terms of service, Apple will have the right (and will be deemed to have accepted the right) to enforce these terms of service against you as a third-party beneficiary thereof. The TruthMap App subscription is found within your iCloud account and cannot be canceled by TruthMap, Inc. The user must login to their apple account to cancel a mobile app subscription.
Google Play App
The following applies if you obtain the App from Google Play (or its successors) operated by Google Inc. ("Google"). You acknowledge and agree that these terms of service are solely between you and TruthMap, Inc., not Google, and that Google has no responsibility for the App or its contents. Your use of the App must comply with the Google Play Terms of Service or other terms applicable to the use of the App. You acknowledge that Google bears no obligation or responsibility for maintenance and support services with respect to the App. To the maximum extent permitted by applicable law, Google will have no warranty obligation whatsoever with respect to the App, and any claims, losses, liabilities, damages, costs, or expenses attributable to any failure of the App to conform to any warranty will be solely governed by these terms of service and any law applicable to TruthMap, Inc. as a provider of the App. The TruthMap App subscription is found within your Google account and cannot be canceled by TruthMap, Inc. The user must login to their account to cancel a mobile app subscription.
This Agreement shall be governed by the laws of the United States and the State of Florida, without giving effect to any conflict of laws principles that may provide the application of the law of another jurisdiction. You agree that any claim or dispute relating to the TruthMap Services or this Agreement that is not resolved under the arbitration requirements of this Agreement must be resolved exclusively by a court of competent jurisdiction, federal or state, located in Palm Beach County, Florida, and no other court. You agree to submit to the personal jurisdiction of such courts and to accept service of process from them. If you are a federal, state, or local government entity in the United States using the Services in your official capacity and legally unable to accept the controlling law, jurisdiction or venue clauses above, then those clauses do not apply to you. For such U.S. federal government entities, these Terms and any action related thereto will be governed by the laws of the United States of America (without reference to conflict of laws) and, in the absence of federal law and to the extent permitted under federal law, the laws of the State of California (excluding choice of law). In the event that any provision of these Terms is held to be invalid or unenforceable, then that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions of these Terms will remain in full force and effect. Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision. If you have a concern that needs special attention, TruthMap is committed to working with you to reach a reasonable resolution. For any concern, you may contact us at contact@truthmap.co. If the concern is not resolved satisfactorily within sixty (60) days after we receive your email, and all necessary information, further dispute resolution provisions will apply. You agree that the sole and exclusive forum for any dispute and claim that cannot be resolved informally will be final and binding arbitration. However, if you have infringed or violated, in any manner, TruthMap’s intellectual property rights, you acknowledge that arbitration is not an adequate remedy at law, and we may seek injunctive relief. You agree that the U.S. Federal Arbitration Act and federal arbitration law apply to arbitrations under the Agreement. The arbitration will be governed by the Commercial Arbitration Rules (the "AAA Rules") of the American Arbitration Association ("AAA"), as modified by this Agreement, and will be administered by the AAA. The AAA Rules and forms are available online at www.adr.org, by calling the AAA at 1-800-778-7879. If you are required to pay a filing fee, after TruthMap receives notice that you have commenced arbitration (and you have complied with the dispute resolution requirements in this Agreement), you will be responsible for filing fees. The arbitrator is bound by the terms of this Agreement. All issues are for the arbitrator to decide, including issues relating to the scope and enforceability of this arbitration agreement. Unless TruthMap and you agree otherwise, any arbitration hearings will take place in the county (or parish) of your residence. The arbitrator's award shall be final and binding on all parties, except (1) for judicial review expressly permitted by law or (2) if the arbitrator's award includes an award of injunctive relief against a party, in which case that party shall have the right to seek judicial review of the injunctive relief in a court of competent jurisdiction that shall not be bound by the arbitrator's application or conclusions of law. YOU AND TruthMap AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Further, unless both you and TruthMap agree, the arbitrator may not consolidate more than one person's claims with your claims and may not otherwise preside over any form of a representative or class proceeding. If this specific provision is found to be unenforceable, then any putative class action may only proceed in a court of competent jurisdiction and not in arbitration. WE BOTH AGREE THAT, WHETHER ANY CLAIM IS IN ARBITRATION OR IN COURT, YOU AND TruthMap BOTH WAIVE ANY RIGHT TO A JURY TRIAL INVOLVING ANY CLAIMS OR DISPUTES BETWEEN YOU AND TruthMap.
THE SITE AND THE CONTENT ARE PROVIDED "AS IS" AND WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, TruthMap DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, TITLE, COMPATIBILITY, SECURITY, ACCURACY, OR NON-INFRINGEMENT. WITHOUT LIMITING THE FOREGOING, TruthMap MAKES NO WARRANTY THAT (I) THE SITE OR THE CONTENT WILL MEET YOUR REQUIREMENTS; (II) THE SITE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; (III) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SITE WILL BE ACCURATE OR RELIABLE; (IV) THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL PURCHASED OR OBTAINED BY YOU THROUGH THE SITE WILL MEET YOUR EXPECTATIONS; (V) ANY ERRORS IN THE SOFTWARE WILL BE CORRECTED; OR THAT (VI) THE SITE OR ANY CONTENT WILL BE MAINTAINED OR FREE FROM BUGS, VIRUSES, TROJAN HORSES, OR OTHER DESTRUCTIVE CODE. UNDER NO CIRCUMSTANCES SHALL TruthMap BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, CONSEQUENTIAL, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING, BUT NOT LIMITED TO, LOST PROFITS AND BUSINESS INTERRUPTION, WHETHER IN CONTRACT OR IN TORT, INCLUDING NEGLIGENCE, ARISING IN ANY WAY FROM ANY PRODUCT OR SERVICE SOLD OR PROVIDED ON THE SITE OR THE USE OF THE INFORMATION OR THE RESULTS OF THE USE OF THE INFORMATION PROVIDED ON THE SITE, EVEN IF TruthMap IS EXPRESSLY ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL TruthMap’s LIABILITY EXCEED THE PRICE YOU PAID FOR A PRODUCT OR SERVICE THAT IS THE SUBJECT OF THE CLAIM.
You agree to indemnify, defend, and hold harmless TruthMap, its affiliates, officers, directors, employees, agents, licensors, suppliers, and any third-party information providers from and against all losses, expenses, damages, and costs, including reasonable attorneys' fees, resulting from any violation of these Terms and Conditions by you or arising from or related to any content submitted, posted, or otherwise provided by you or any other user of the Site.
Unless otherwise specified herein, this Agreement constitutes the entire agreement between you and TruthMap, Inc. with respect to the Site and supersedes all prior or contemporaneous communications and proposals (whether oral, written, or electronic) between you and TruthMap, Inc. with respect to the Site. If any part of this Agreement is held invalid or unenforceable, that portion shall be construed in a manner consistent with applicable law to reflect, as nearly as possible, the original intentions of the parties, and the remaining portions shall remain in full force and effect.
TruthMap reserves the right to terminate an end user's account or access to its services, products, or mobile application at its sole discretion. The following circumstances, may lead to the termination of an end user's account but is not limited to the following: Violation of Terms and Conditions: End users who violate the Terms and Conditions of TruthMap, including but not limited to engaging in fraudulent activities, unauthorized use of the platform, or any behavior deemed harmful to other users or the platform itself, may face termination. Breach of Data Privacy: Any breach of data privacy and security measures, including attempts to access or misuse other users' information, may lead to immediate termination. Legal Requirements: TruthMap may terminate an end user's account if required to do so by law or in response to a valid legal request. Discontinuation of Services: TruthMap may decide to discontinue its services, products, or mobile application entirely, leading to the termination of all end user accounts.
In consideration for our granting you access to and use of the Services, you agree that we and our third-party providers and partners may place advertising on the Services or in connection with the display of Content or information from the Services whether submitted by you or others. You also agree not to misuse our Services, for example, by interfering with them or accessing them using a method other than the interface and the instructions that we provide.
At TruthMap, we take data privacy and security seriously. We implement measures to protect end user information from unauthorized access, disclosure, alteration, or destruction. We maintain administrative, technical, and physical safeguards to safeguard user data.
TruthMap utilizes certain third-party software to enhance its mobile application and website functionality. The third-party software providers we use include Goodbarber.com, Landbot.io, and Typeform.com. While we take utmost care in selecting and partnering with reputable third-party providers, we cannot guarantee their data privacy and security practices. End users are encouraged to review the privacy policies and security measures of these third-party companies independently. TruthMap shall not be held liable for any data privacy breaches or security incidents caused by these third-party providers.
End users acknowledge and accept full responsibility for regularly checking the websites of the aforementioned third-party software providers, namely Goodbarber.com, Landbot.io, and Typeform.com, to stay informed about any announcements or updates regarding data privacy breaches or security incidents. TruthMap will not be obligated to report on behalf of these third-party providers in case of any data privacy breach or security incident. By using TruthMap's services, products, or mobile application, end users agree to abide by this Data Privacy and Security Clause and understand that TruthMap's liability is limited to its own data privacy and security measures, not extending to those of third-party software providers.
THE SITE AND THE CONTENT ARE PROVIDED "AS IS" AND WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, TruthMap DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, TITLE, COMPATIBILITY, SECURITY, ACCURACY, OR NON-INFRINGEMENT. TruthMap Inc may revise these Terms from time to time. The changes will not be retroactive, and the most current version of the Terms, which will always be available here (Terms & Conditions) and here (Privacy Policy), will govern our relationship with you. Other than for changes addressing new functions or made for legal reasons, we will notify you 30 days in advance of making effective changes to these Terms that impact the rights or obligations of any party to these Terms, for example via a service notification or an email to the email associated with your account. By continuing to access or use the Services after those revisions become effective, you agree to be bound by the revised Terms. In the event that any provision of these Terms is held to be invalid or unenforceable, then that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions of these Terms will remain in full force and effect. TruthMap Inc's failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.
